Referring to the discussion on fences, would it still be considered level 3 deficiencies should Mgt be in
the process of repair or replacing an entry gate/latch on day of REAC inspection?

In any situation where a repair is under way or under contract for completion in the near future, REAC’s policy is that the inspector must cite the defect and then you must submit an appeal, to try to get the defect taken off the report. Appeals are a tricky process, and I recommend trying to never rely on an appeal if you can complete the work instead.
